The toy was packed inside a oval plastic container which was hidden by the milk chocolate. The egg was then wrapped in kinder surprise tin foil. The eggs were sold in packs of three or solo. The chocolate egg was two layered with a brown chocolate cover and an inner white layer.

Unknown to most canadian children these chocolate eggs were illegal to sell in the united states. The united states has a law that forbids toys to be hidden in chocolate for chocking and safety measures. This lead to multiple instances where canadian kids would ask for kinder surprises in the united states and be met with strange faces as many people didn't even know they existed.

There are also people who try to sneak in kinder surprises into the united states that get fined thousands of dollars per egg as the law is strict. In 2018 kinder joy will release a line in the united states. This chocolate is shaped like an egg but the toy and the chocolate are in separate packaging. This is allowed in the united states because the toy isn't hidden in the chocolate.
